Texas Drug Possession Penalties by Substance & Quantity

Texas classifies controlled substances into penalty groups under Chapter 481 of the Texas Health and Safety Code, known as the Texas Controlled Substances Act. The penalty group a substance falls into, combined with the amount possessed, determines whether the charge is a misdemeanor or a felony and the applicable sentencing range.

Penalty Group 1

Cocaine, methamphetamine, heroin, opioids, and GHB fall under Penalty Group 1. Possession of less than one gram is a state jail felony carrying 180 days to 2 years in state jail and a fine of up to $10,000. Larger amounts escalate to third-degree, second-degree, and first-degree felonies.

Penalty Group 1-B

Fentanyl and its analogs are classified under Penalty Group 1-B. Prosecutors can pursue felony charges aggressively even for small amounts, and the sentencing ranges reflect the severity with which Texas treats fentanyl offenses.

Penalty Group 2 & THC Concentrates

MDMA, psilocybin, and THC concentrates fall under Penalty Group 2.
